Welcome to Match2Fix! These Terms of Service (“Terms”) form a legally–binding contract between Match2Fix, LLC (“Match2Fix,” “we,” “our,” or “us”) and you (“you” or “User”). They govern your access to and use of the Match2Fix mobile apps, websites, APIs, widgets, and all related services (collectively, the “Services”). By accessing or using any part of the Services you agree to these Terms. If you do not agree, do not access or use the Services.

1 Eligibility & Account Registration

  1. Minimum age. You must be at least 13 years old (or the age of digital consent in your jurisdiction, if higher) to use the Services.
  2. Account accuracy. When you create an account you agree to provide true, current, and complete information and to keep it up-to-date.
  3. Account security. You are responsible for safeguarding your login credentials. Notify us immediately of any unauthorized use. We are not liable for losses arising from unauthorized use of your account.

2 License & Acceptable Use

  1. Limited license. Subject to these Terms, Match2Fix grants you a non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial home-repair needs.
  2. Prohibited conduct. You agree not to:
    • Violate any law, regulation, or third-party right;
    • Upload unlawful, defamatory, obscene, or infringing content;
    • Reverse-engineer, decompile, or scrape the Services;
    • Interfere with or disrupt the integrity, security, or performance of the Services;
    • Use any robot, spider, or other automated means to access the Services except through our published APIs;
    • Resell, sublicense, or otherwise exploit the Services commercially without our written consent.

We may investigate violations and suspend or terminate accounts at our sole discretion.

3 User-Generated Content

  1. Your content. You may upload photos, videos, documents, text descriptions, feedback, and other content (“User Content”). You retain all ownership rights in your User Content.
  2. License to us. By submitting User Content you grant Match2Fix a worldwide, royalty-free, sublicensable license to host, store, process, reproduce, display, adapt, and otherwise use that content solely to operate, improve, and promote the Services (including to train and fine-tune AI models).
  3. Representations. You represent that you have all necessary rights to upload the User Content and that its use will not infringe or violate any law or third-party right.

4 Paid Features & Refunds

Some advanced features may require payment (e.g., extra diagnostic credits, subscription tiers). Prices, billing terms, and refund policies will be disclosed in-app or at the point of purchase. All fees are non-refundable except as required by applicable law or our posted refund policy. You authorize us (and our payment processors) to charge your chosen payment method for all purchases.

5 Third-Party Services

The Services integrate third-party platforms such as Firebase, Google Cloud Vision, OpenAI, and Cloudinary. Your use of those services may be subject to separate terms. Match2Fix is not responsible for third-party services we do not control.

6 Intellectual Property

  1. Our IP. The Services, including all software, text, graphics, logos, and trademarks (other than your User Content), are owned by Match2Fix or its licensors and are protected by intellectual-property laws.
  2. Feedback. If you send us suggestions or ideas, you grant Match2Fix an unrestricted, perpetual license to use them for any purpose without compensation to you.

7 AI-Powered Results & Disclaimers

Match2Fix uses AI models and computer-vision services to generate diagnostic suggestions. These outputs are informational only and do not constitute professional or legal advice. Always consult a qualified contractor or inspector before undertaking repairs. We make no warranties that AI outputs are accurate, complete, or fit for a particular purpose.

8 Warranties & Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MATCH2FIX DISCLAIMS ALL WARRANTIES (EXPRESS OR IMPLIED), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MATCH2FIX, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES OR LOSSES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so the above may not apply to you in full.

10 Indemnification

You agree to defend, indemnify, and hold harmless Match2Fix, its affiliates, officers, and employees from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from (i) your use of the Services, (ii) your User Content, or (iii) your violation of these Terms or any law.

11 Termination

You may stop using the Services at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or pose a risk to us or other users. Sections 6–13 will survive any termination.

12 Modifications to the Terms

We may modify these Terms from time to time. Material changes will be announced by posting the updated Terms and updating the “Effective Date” above; we may also provide in-app or email notice. Your continued use after changes become effective constitutes acceptance of the revised Terms.

13 Governing Law & Dispute Resolution

  1. Governing law. These Terms are governed by the laws of the Commonwealth of Pennsylvania and the United States, without regard to conflict-of-law rules.
  2. Informal resolution. Before filing a claim, you agree to contact us at info@match2fix.com to seek an informal resolution.
  3. Binding arbitration. If we cannot resolve a dispute informally within 60 days, any claim arising out of or relating to the Services will be finally settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. You and Match2Fix waive the right to a jury trial and to participate in a class action.
  4. Venue. Unless arbitration is required, the federal or state courts in Philadelphia, PA will have exclusive jurisdiction.

Certain claims (e.g., small-claims actions, requests for injunctive relief over IP rights) may be brought in court despite this arbitration clause.

14 Miscellaneous

  • Entire agreement. These Terms and any policies referenced (e.g., our Privacy Policy) constitute the entire agreement between you and Match2Fix.
  • Severability. If any provision is held invalid, the remainder remains in effect.
  • Assignment. You may not assign your rights under these Terms. We may assign or transfer them without restriction.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Force majeure. We are not liable for delays or failure caused by events beyond our reasonable control.
